Last updated: September 7, 2026 • Effective as of the date first accepted
Not a Law Firm
Doxa Privacy does not provide legal advice.
Human Review
Automated outputs do not replace professional review.
Section 16
Arbitration and class-action waiver provisions apply.
1. Acceptance of Terms
These Terms and Conditions ("Terms") form a binding agreement between you ("you," "your," or "Customer") and Bantu Heirs LLC, a Wyoming limited liability company doing business as Doxa Privacy ("Doxa," "we," "us," or "our"), governing your access to and use of the Doxa Privacy websites, the Doxa Scanner, and all related applications, tools, content, and services (collectively, the "Service"). By accessing, browsing, registering for, or otherwise using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service.
If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization to these Terms, and "you" refers to that organization.
2. Definitions
- "Scanner" means the Doxa Scanner, a tool that performs a point-in-time review of publicly available web pages that you identify.
- "Paid Services" means any feature offered for a fee, including automated privacy-notice generation, Privacy Impact Assessments (PIAs), and other assessment or compliance products.
- "Output" means any report, score, band, notice, assessment, observation, or other material generated by the Service.
- "Customer Content" means data, text, files, URLs, and other materials you submit to or generate through the Service.
- "Target" means any web page, domain, application, or property that you submit to the Scanner or otherwise instruct the Service to review.
3. Eligibility & Accounts
You must be at least 18 years old and capable of forming a binding contract. Certain features are available without an account; others require registration. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us promptly at [email protected] of any unauthorized use. You agree to provide accurate information and to keep it current.
4. The Service
Doxa provides privacy-risk and compliance tooling built on a contextual-integrity framework, including the Scanner and Paid Services. The Service produces observations and informational materials intended to assist your own review and decision-making. Availability, features, and functionality may change, be suspended, or be discontinued at any time. Free features (including anonymous or signed-in Scanner use) are provided as-is and may be rate-limited or withdrawn.
5. Scanner & Authorization to Scan
The Scanner fetches and analyzes publicly available pages at your instruction. It provides a point-in-time snapshot only and does not continuously monitor any Target. Results depend on what is publicly accessible at the moment of the scan and may be incomplete, out of date, or affected by the Target's configuration.
Your authorization and responsibility. By submitting a Target, you represent and warrant that you own the Target, are authorized by its owner, or are otherwise legally permitted to have it scanned. You are solely responsible for ensuring that your use of the Scanner complies with all applicable laws, the Target's terms of use, and any technical access controls (such as robots directives or authentication). You agree not to use the Scanner against any property you are not authorized to test, and you will indemnify Doxa for any claim arising from an unauthorized scan.
6. Paid Services, Fees & Billing
Pricing for Paid Services is presented at the point of purchase. Unless stated otherwise, fees are quoted in U.S. dollars, are due in advance, and are non-refundable except where required by law or expressly stated. You authorize us and our payment processors to charge your selected payment method for all applicable fees and taxes. We may change prices prospectively; changes do not affect an already-purchased one-time service. Failure to pay may result in suspension or termination of access. You are responsible for all taxes other than taxes on Doxa's net income.
7. Acceptable Use
You agree not to:
- Use the Service in violation of any law or third-party right;
- Submit any Target you are not authorized to scan, or use the Service to probe, breach, or circumvent security;
- Reverse engineer, decompile, scrape, or attempt to derive the Service's scoring models, generation logic, or source code, except to the extent this restriction is prohibited by law;
- Resell, sublicense, or provide the Service to third parties as a commercial bureau without our written consent;
- Introduce malware, overload or disrupt the Service, or use automated means to access it beyond documented limits;
- Misrepresent Output as a legal opinion, certification, or regulatory determination;
- Upload content that is unlawful, infringing, or that you lack the right to submit.
8. Your Content & Data
You retain all rights in your Customer Content. You grant Doxa a limited, non-exclusive, worldwide, royalty-free license to host, process, transmit, and display Customer Content solely to operate and provide the Service to you, to maintain and improve the Service in de-identified or aggregated form, and as otherwise described in our Privacy Policy. You are responsible for the accuracy and legality of Customer Content and for having any necessary rights and consents. Scan history is retained only when you are signed in, as described in the Privacy Policy.
9. No Legal Advice; No Attorney–Client Relationship
Doxa Privacy is not a law firm, and no part of the Service constitutes legal advice. Bantu Heirs LLC operates a software platform; it does not practice law. Individuals associated with Doxa may hold legal credentials, but they do not act as your attorney through the Service, and your use of the Service does not create an attorney–client relationship. No confidential or fiduciary relationship is formed, and communications through the Service are not protected by the attorney–client privilege.
Output is an observation, not a verdict. Every score, band, notice, assessment, and report generated by the Service is an automated, informational observation about publicly available or user-supplied information. It is not a legal conclusion, compliance certification, audit opinion, or determination of whether any law applies to you or has been satisfied. Automated detection may produce false positives or false negatives and requires human review. You should not rely on any Output as a substitute for the advice of a qualified attorney or other professional retained to assess your specific circumstances. You are solely responsible for your compliance decisions and for obtaining independent legal counsel where appropriate.
10. Intellectual Property
The Service, including its software, models, rubrics, citation registries, designs, text, and the "Doxa," "Doxa Scanner," and "Privacy in Context" marks, is owned by Doxa or its licensors and is protected by intellectual-property laws. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Service and to use Output for your own internal business or personal purposes. You receive no other rights. You may not remove proprietary notices. Any feedback you provide may be used by us without obligation to you.
11. Third-Party Services & Content
The Service may link to or interact with third-party websites and services, including the Targets you scan. We do not control and are not responsible for third-party content, practices, or availability. Your dealings with third parties are solely between you and them.
12. Privacy
Our collection and use of personal information is described in our Privacy Policy. By using the Service, you consent to those practices.
13. Disclaimers of Warranties
The Service and all Output are provided "AS IS" and "AS AVAILABLE," without warranties of any kind. To the fullest extent permitted by law, Doxa disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, title, non-infringement, and any warranty that the Service will be uninterrupted, error-free, secure, accurate, complete, or current. Doxa does not warrant that any Output will identify all privacy risks or satisfy any legal or regulatory requirement.
14. Limitation of Liability
To the fullest extent permitted by law, Doxa and its members, officers, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, goodwill, or business, arising out of or relating to the Service or these Terms, even if advised of the possibility. Doxa's total aggregate liability for all claims relating to the Service will not exceed the greater of (a) the amounts you paid to Doxa for the Service in the twelve (12) months before the event giving rise to the claim, or (b) USD $100. Some jurisdictions do not allow certain limitations; in those jurisdictions our liability is limited to the maximum extent permitted.
15. Indemnification
You will defend, indemnify, and hold harmless Doxa and its members, officers, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your Customer Content, your use of the Service, your submission of any Target you were not authorized to scan, or your violation of these Terms or any law or third-party right.
16. Dispute Resolution; Binding Arbitration; Class-Action Waiver
Please read this section carefully — it affects your legal rights.
Informal resolution. Before filing any claim, you agree to first contact us at [email protected] and attempt in good faith to resolve the dispute informally for at least thirty (30) days.
Binding arbitration. Except as stated below, any dispute, claim, or controversy arising out of or relating to the Service or these Terms will be resolved by final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer or Commercial Rules, as applicable. The arbitration will be seated in, and governed by the law of, the State of Wyoming, and may proceed by videoconference or on documents where the rules permit. Judgment on the award may be entered in any court of competent jurisdiction.
Class-action waiver. All claims must be brought in your individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims or preside over any form of a representative or class proceeding.
Small-claims carve-out. Either party may bring an individual claim in a small-claims court of competent jurisdiction instead of arbitration. Nothing here prevents either party from seeking injunctive or equitable relief in court to protect its intellectual-property or confidential information.
Opt-out. You may opt out of this arbitration agreement by emailing [email protected] within thirty (30) days of first accepting these Terms, stating your intent to opt out. If any portion of this section is found unenforceable, the remainder will continue to apply, except that if the class-action waiver is found unenforceable, this entire arbitration section will be void.
17. Term & Termination
These Terms apply while you use the Service. You may stop using the Service at any time. We may suspend or terminate your access, with or without notice, for any violation of these Terms or to protect the Service or other users. Upon termination, the license granted to you ends; Sections that by their nature should survive (including 8–10 and 13–20) will survive.
18. Changes to the Terms or Service
We may modify these Terms from time to time. If we make material changes, we will update the "Last updated" date and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance. We may also add, change, or remove Service features at any time.
19. Governing Law & Venue
These Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-laws rules. Subject to the arbitration agreement in Section 16, you and Doxa consent to the exclusive jurisdiction and venue of the state and federal courts located in Wyoming for any dispute not subject to arbitration.
20. General Provisions
- Entire agreement. These Terms and the documents referenced here are the entire agreement between you and Doxa and supersede prior agreements on the subject.
- Severability. If any provision is unenforceable, the rest remains in effect.
- No waiver. Our failure to enforce a provision is not a waiver.
- Assignment. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
- Force majeure. Neither party is liable for delays caused by events beyond its reasonable control.
- Notices. We may provide notices via the Service or the email associated with your account.
- Relationship. The parties are independent contractors; these Terms create no partnership, agency, or joint venture.
